Update Kaufvertrag

As I sat here thinking about Becky's lake idea, my husband called Haegerhof again and said OK what now.

They said they cannot guarantee a horse will never cough again.

J said, "Naturally not.  We are referring to a chronic problem. COPD."

Haegerhof was not aware of this term. I had not fully researched that there is a German layman term for it, "Daempfigkeit."

They said "Let us look it up and get back to you."

***

***I watch Doctor Who for a while***

***

They actually called us back.

"Oh, Daempfigkeit. We won't sell  you a horse with that."

They said they will not reduce the price of the horse due to our vet bills, because they said they would have raised the price of the horse during the last 8 weeks, but rather than continue to show him to buyers, they kept him in recovery one week, and rode him regularly the other 7 weeks. Huh?

"Send us your street address and we'll send you a contract, including the clause that we'll take the horse back if he has COPD."

"And shipment?"

"We will send you a recommendation for a professional, otherwise we'll want 70cents per km ....under the table."

I already have a shipper in mind, but we'll see what they send us.

All I can say is ...huh.

We'll see what happens now.

Get him!!

I wish they would just email you the contract. It is hard to wait! Thanks for keeping us in the loop, we are getting excited!

Huh indeed. Every interaction with Haegerhof you have makes me like them less. But if they have what you want I guess you have to deal with them!

I seriously doubt they have put an additional 7 weeks of riding on Mag. And he is more valuable now that you have made him more healthy! But that is your investment, not theirs.

I wish they'd cover some of the vet bills, but I think if you want this horse you'll have to compromise with this farm. Once Mag is home with you this will all be worth it.

They are so weird.

I suspect they felt inconvenienced by the vet checks and were hoping for an uncomplicated sale, so they don't want to do you any favors. They're trying to make it sound like they lost potential sales while he was in recovery, yet no one bought him during those other 7 weeks. Good luck.

grit your teeth, I guess? and hire your own shipper.

and. keep us posted.

gaaaaahhhhh.

Kbryan, I had misunderstood. They are emailing the contract! I'll let you know when it arrives and what it says.

Unknown, they told me they were not going to continue riding him when he was ill. Now they are saying the opposite to make him seem more valuable to us. I always say, how I feel about a seller is irrelevant but sheesh...I did not like Haegerhof in 2012, and I didn't in 2015, and I don't in 2016...: ) They are large scale horse dealers. I looked at the Polish state stud's sale page yesterday and saw many names of horses standing in Haegerhof's barns, and those are only the ones they bought at the December sale! They also breed Egyptian Arabians, but their main business is moving cheap horses from Poland into Germany. These are well bred horses but they are mass produced.

Here is the sale list from Dec, these are the "throwaways" that didn't make it to their big auction. http://www.michalow.arabians.pl/en/sales/2015/12-05.php

Mag was in another list from 2013 and that's how I got his canon bone measurement : )

Irish, there is still the possibility that they will compromise, when I see the contract.....*holds breath*

ABS, when we showed up to look at horses in Nov, J was like, "Talk to them, why are you so silent? They want to know what you know, what you want. You're acting like you don't like horses!" True, I was sullenly standing there, not in the mood to chat with them. J did most of the talking. I was thinking, "You people messed with me in 2012, and I don't have any reason to think you won't mess with me again." I only went out there because S had visited and photographed Mag for me, and told me he's as calm as he looks in the photos.

There is a simple way to make me a satisfied customer at this point - drop the price even by a tiny bit. Otherwise, I'll never refer anyone to them.

One nice thing about them being dealers, they never once asked me about how I'd be keeping Mag. They never asked if I have other horses, or if he'll be going into a big show barn, nothing. They likely don't care if I use him for meat.

NM, I'm curious whether they care about customer satisfaction at all. I'll find out when I see the contract. Can you believe how long this process has taken? I met the horse in November.

Aarene, I have a quote for 300E for shipping from someone so we'll see what works out to be most affordable. 300E is really good for such a distance, that's an all day road trip - they can't take a horse trailer 160kph.

there's money.. and there's "something went wrong and now your horse is injured/sick/not returnable.

I don't trust 'em.

Becky Bean said...

I don't trust them either.

"Of course we won't work the horse while he is recovering, nor will we show him while you are paying for his treatment," turned into "Heck no you won't be reimbursed for curing our sellable horse - we worked him 6 days a week with our top notch trainers for 7 weeks straight and now he's worth double what he was when you saw him..... You're lucky we're only charging you the same amount."

Or, you know, whatever polite German variation of that lie they uttered.

I'll be very happy for you if you get him, but the deal and the cavalier way they're treating it makes me very uneasy. Honest people about to make money on a sound horse to a good home don't drag their feet like this.... at least not here in the states.

I'm not trying to rain on your parade, I just... I just worry a little bit.

He is gorgeous though. I love his eye and his solid conformation, and most of all I like the way you seem to light up on the internet when you talk about him. I've got my fingers crossed for you.

Aarene,
Becky,

I got the invoice tonight for the horse. I say invoice cuz that's exactly what it is. Not a contract, really, not in comparison to the booklet we both bought and sold Mara with with all sorts of stipulations, both mental and physical. No, this is just an invoice. With typesetting from the 70s. Buyer/Seller data, horse data (saying he was born on Jan 1 2011, !!!) and price INCLUDING taxes. No discount whatsoever, *sigh * OK THEN.

A clause: If he has COPD, they buy him back within 12 months. I'm happy about that.

Now, before we sign, we want to know about this Jan 1 birthday.

That is the date used when a real date is unknown.

He is supposed to be both papered and registered, whatever that means in Germany. Horses here have passports but that is mostly a veterinary thing. My cat and my donkey have passports. Baasha never did. He was an American immigrant, allowed in from his AHA papers based on his brand.

I've seen the parentage, I've read the sale list with him on it from the state stud, listing his parentage as well.
I have no idea.

I'm curious about the brands too.

The very best we can every do with a horse is buy the best we can, and then train the best we can, both if possible. I want to be able to do both this time. To give him the best chance if, after all, he is another horse who I cannot connect with.

I've already settled on my transport company from Hanover. The offers from Haegerhof were both way too high, and the one my husband looked up was also too high.

Tonight we wait again.

Camryn said...

Glad they added the clause for you. Kind of sounded as if they wouldn't at first. I'm sure you'll breath a huge sigh of relief (as will Mag) when he's on the way. That's to sad that they feel the need to lie regarding his remaining in training.

Aarene, what do you mean? Are you worried about my shipper? I showed J her website and she doesn't have a fancy horse van (UPS van type thing used in Europe for fancy horses) - just a trailer with a camera. ? I don't have references, but I don't have references for ANY shipper in Germany. I was joking tonight, "I should just go get the horse. (If that was legal, but it's not.) What? Am I kidding? I'm not driving up there again for anything!"

Camryn, it really makes me ponder the depths of greed, what it means. That no percentage of a sale is worth sacrificing even to win a customer for life. I am a brand loyalist, if you didn't know. I am devoted to brands (Toyota, Irideon) that have worked for me for years and will propagate reliance to everyone around me who asks.

I cannot prove it was a lie, the 7 weeks of continual training, but I will never give them a good recommendation, not matter how well bred and strong boned their cheaply obtained Arabians are. *sigh* Thanks for reading and sharing during this stressful time. Hey, maybe I've put a light upon them showing what they must defend in the future. Sadly not likely though, as my blog is not searchable by the public.

I just heard back and Mag was indeed born on 1/1 (like my mom) because Michalow State Stud does that. (I saw today that they have a list of January babies and I was like huh!?!)

They say Mag has both a pass and papers, but I'm still not clear on if that means papers plus registration, and what registry that might be, if there is one in Europe. Tricky.

Also no news yet on brands, but I'm not going to let this go. There must be a meaning behind the numbers they put on horses, otherwise, why put numbers on horses. Hrpmh! So far on this, google has failed me.

Ugh, nothing like dealing with a horse trader! It seems all these guys care about is getting the money. They know you are very interested and want this horse, so they aren't going to drop the price. It does not mean there is something wrong with the horse, he looks lovely. I hope it works out and you have a new horse soon!!!

Olivia @ DIY Horse Ownership said...

The whole thing sounds fishy. I really hate dealing with horse brokers. All the lies and changing stories are just so frustrating. Good luck with the contract.

AareneX said...

I'm not worried about YOUR shipper, I'm worried about them.

Their pants seem to be on fire at times. Must be super-awkward at parties.

Wow what a frustrating ordeal! Sorry they are treating you poorly. It sounds like all they care about is the money. :-( I can't wait for him to be home with you so you can just forget all about them and enjoy your new horse!
